Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the SiteViser website (www.siteviser.com) and the SiteViser monitoring service accessed via app.siteviser.com (the "Service") operated by Sageble LTD ("us", "we", or "our").
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.
1. Definitions
- "Service" refers to the SiteViser SaaS platform available at app.siteviser.com, including all features and functionalities offered, such as Domain Monitoring, Server & Mail Info, Blacklist Check, Site Speed & Performance, Uptime Monitoring, SSL Certificate Tracker, DNS Change Alerts, Email Health Check, Search Index Tracker, SEO Reports & Tips, Technical Support, and the Centralized Dashboard.
- "Marketing Site" refers to the website located at www.siteviser.com, containing informational content, landing pages, and legal documents.
- "User", "You", "Your" refers to the individual or entity registering for or using the Service.
- "Account" refers to the user account created to access the Service.
- "User Data" refers to the personal information provided by the User during registration and use of the Service, including first name, last name, email address, password (hashed), domain names, and email addresses associated with those domains.
- "Subscription" refers to the paid plan selected by the User to access specific features and usage limits of the Service.
- "Content" refers to information, data, text, graphics, or other materials generated, provided, or otherwise made accessible on or through the Service, excluding User Data.
- "Company", "We", "Us", "Our" refers to Sageble LTD, registered in England and Wales (Company Registration Number: 16106650), the legal entity operating the SiteViser Service.
2. Accounts
When you create an account with us, you guarantee that you are at least 18 years of age and that the information you provide is accurate, complete, and current. Providing false, inaccurate, incomplete, or obsolete information may result in the immediate termination of your Account on the Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your Account.
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.
3. Use of the Service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
- In any way that violates any applicable national or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the UK, EU, US or other countries).
- To monitor domains or websites for which you do not have legitimate ownership or explicit authorization to monitor.
- To engage in any activity that interferes with or disrupts the Service (or the servers and networks which are connected to the Service).
- To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
- To transmit, or procure the sending of, any "junk mail", "chain letter," "spam," or any other similar solicitation.
- To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
- In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
The Service fetches publicly available information related to domains and websites using third-party APIs. You understand that the accuracy and availability of this information depend on these third-party sources and public accessibility.
4. Subscriptions, Payments, and Renewals
Certain parts of the Service are available only with a paid Subscription. Subscriptions are billed in advance on a recurring, periodic basis ("Billing Cycle"). Billing Cycles are typically set on a monthly basis.
At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Sageble LTD cancels it. You can cancel your Subscription renewal at any time through your Account settings page within the Service (app.siteviser.com).
A valid payment method is required to process the payment for your Subscription. We use Stripe, a third-party payment processor, to handle payments. You must provide Stripe with accurate and complete billing information. By submitting payment information, you authorize us (through Stripe) to charge all Subscription fees incurred through your Account to any such payment instruments.
We do not store your credit card details. All payment information is securely handled by Stripe, subject to their terms and privacy policy.
Fee Changes: Sageble LTD, in its sole discretion and at any time, may modify the Subscription fees. Any Subscription fee change will become effective at the end of the then-current Billing Cycle. We will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.
Refunds: Except when required by law, paid Subscription fees are non-refundable. Certain refund requests for Subscriptions may be considered by us on a case-by-case basis and granted at our sole discretion.
5. Intellectual Property
The Service and its original Content (excluding User Data), features, and functionality are and will remain the exclusive property of Sageble LTD and its licensors. The Service is protected by copyright, trademark, and other laws of the United Kingdom and foreign countries. Our trademarks and trade dress (including the name "SiteViser") may not be used in connection with any product or service without the prior written consent of Sageble LTD.
You retain ownership of any intellectual property rights that you hold in the domains and associated information you provide for monitoring.
6. Account Termination
We may terminate or suspend your Account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of these Terms.
If you wish to terminate your Account, you may do so at any time by using the account deletion feature within the Service interface or by contacting us at info@siteviser.com. Upon termination, your right to use the Service will immediately cease, and we will delete your User Data in accordance with our Privacy Policy.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
7. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Service is at your sole risk. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Sageble LTD, its subsidiaries, affiliates, and its licensors do not warrant that: a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service (including data fetched from third-party sources) will be accurate, reliable, complete, or meet your requirements.
8. Limitation of Liability
In no event shall Sageble LTD, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service (including information fetched about domains); (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Our maximum aggregate liability under or in connection with these Terms whether in contract, tort (including negligence) or otherwise, shall in all circumstances be limited to the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim.
9. Indemnification
You agree to defend, indemnify and hold harmless Sageble LTD and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, typically via email or a notice within the Service. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
